These terms apply to every quote, order and delivery by Nicki Gifts, unless agreed otherwise in writing. By placing an order you accept these terms.
Our quotes are without obligation and valid for thirty days, unless stated otherwise. Prices are in euro. For consumers the prices shown include VAT; for business customers prices are quoted excluding VAT unless stated otherwise. Shipping costs are always listed separately.
An order is formed once you confirm it in writing. For bespoke work we first present a design proposal. Production only starts after you have approved that design. You are responsible for the accuracy of names, dates and wording in the approved design. Errors noticed only after approval cannot be corrected free of charge.
You warrant that you hold the necessary rights to any logos, images and text you send us. Nicki Gifts does not produce runs featuring protected brands or characters for which you have no permission. If you supply an object yourself for engraving or printing, we agree in advance what happens in the event of damage; the risk of the material breaking remains with you.
For bespoke work we usually ask for a deposit before production starts, because a personalised piece cannot be resold. Invoices are payable within fourteen days of the invoice date unless agreed otherwise. Late payment attracts statutory interest by operation of law and without notice of default.
Lead times are always approximate: typically 1 to 2 weeks for pieces from our collection and 3 to 4 weeks for new bespoke work or larger runs. Between October and December these periods lengthen. Exceeding a lead time does not give rise to compensation or to cancellation, unless expressly agreed otherwise.
You can collect your order from our workshop by appointment, or have it shipped within Belgium and the Netherlands. Risk passes at the moment of collection or handover to the carrier.
Consumers normally have a statutory fourteen-day right of withdrawal on distance sales. That right does not apply to goods made to your specifications or clearly intended for a specific person (Article VI.53, 3° of the Belgian Code of Economic Law). That covers virtually all of our bespoke work, which is exactly why we always have you approve the design first. For non-personalised items from our standard range the right of withdrawal does still apply.
Please check the delivery on receipt. Report visible defects or transport damage within seven calendar days to info@nickigifts.com, with photographs. Consumers have the statutory two-year warranty against lack of conformity. Normal wear, fading from sunlight, and damage caused by misuse or exposure to damp and frost are not covered.
Our layered signs and door hangers are intended for a sheltered position. Prolonged exposure to rain or frost can damage the wood and the paint. Cutting and serving boards should be washed by hand; they do not belong in the dishwasher.
Our liability is limited to the invoice value of the order concerned. We are not liable for indirect loss such as loss of profit or missed opportunities. Nothing in these terms limits our liability for intent, gross negligence or personal injury.
Belgian law applies to our agreements. Disputes fall to the courts of the judicial district of West Flanders, Veurne division. Consumers may also use the European ODR platform at ec.europa.eu/odr.
